Terms of Service

These Terms govern access to and use of Zerkuri, including user accounts, marketplace activity, digital product purchases, selling, payments and community features.

1. About these Terms

By creating an account, accessing Zerkuri or using marketplace features, you agree to these Terms of Service and to the policies incorporated into them by reference.

Additional policies may apply to particular activities, including the Seller Terms, Digital Product Policy, Refund Policy, Privacy Policy and Cookie Policy. If a specific policy conflicts with these general Terms in relation to the subject it specifically regulates, the more specific policy applies to that subject.

2. Zerkuri and the marketplace operator

Zerkuri is an online marketplace for digital creators and buyers. Zerkuri is operated by Berki Dávid Máté, a registered individual entrepreneur in Hungary (registered office: 1214 Budapest, Kazánház utca 11.; registration number: 62703853; tax number: 92302235-1-43; EU VAT number: HU92302235).

Unless Zerkuri is expressly identified as the seller of a particular item, Zerkuri provides the marketplace infrastructure through which independent sellers can offer digital products. The identity and legal status of the seller may affect which consumer rights apply to a transaction.

3. Eligibility and user accounts

You must provide accurate information when creating or operating an account and must keep information reasonably up to date. You are responsible for maintaining the confidentiality and security of your login credentials and for activity carried out through your account.

You may not impersonate another person or business, create an account using misleading identity information, or use Zerkuri in a way that violates applicable law.

4. How the marketplace works

Sellers create listings and determine the content of their digital products, subject to Zerkuri's platform rules. Buyers may browse listings, purchase eligible products and access purchased files through their account when payment has been completed successfully.

Zerkuri may provide search, discovery, reviews, ratings, favourites, creator profiles, achievements, community features and other tools intended to help users interact with the marketplace.

5. Buying digital products

Buyers must review the listing description, included file types, compatibility information and any stated licence terms before purchasing. A completed payment provides the buyer with the access or licence described in the applicable listing and does not transfer copyright or other intellectual property rights unless the listing expressly states otherwise.

Purchased files are intended for the purchasing user and may not be redistributed, resold, sublicensed or made available to third parties unless the applicable product licence expressly permits that use.

6. Selling on Zerkuri

Sellers are responsible for their listings, uploaded files, descriptions, pricing, licences and compliance with applicable law. A seller must have all rights, permissions and licences necessary to upload and sell each product.

Sellers may be required to provide identity, business, tax, contact or payment information where required for marketplace operation, payment processing, seller verification or compliance with legal obligations.

7. Fees, payments and payouts

Zerkuri charges sellers a 12.5% platform fee on successful sales. There is no monthly seller subscription fee, no listing fee and no separate payment-processing fee charged to sellers. Any applicable fee presented before a transaction forms part of the marketplace terms for that transaction.

Payments and seller payout services may be provided through third-party payment providers such as Stripe. Sellers may be required to complete the payment provider's onboarding, identity verification and payout requirements before products can be purchased or earnings can be paid out.

Payout timing can depend on payment status, banking systems, country, account verification, fraud checks, disputes, refunds and the rules of the payment provider.

8. User content and intellectual property

Users retain ownership of content they own. By uploading content to Zerkuri, a user grants Zerkuri the non-exclusive rights reasonably necessary to host, store, reproduce, display, technically process and promote that content for the operation and marketing of the marketplace.

This licence does not give Zerkuri ownership of the seller's original work. It exists so that listings, images and related material can be displayed and delivered through the service.

9. Prohibited activity

Users may not use Zerkuri for illegal, fraudulent, deceptive, abusive or infringing activity. Prohibited conduct includes uploading material without the necessary rights, distributing malware, manipulating reviews or marketplace metrics, attempting to bypass fees, interfering with platform security or using another user's account without permission.

10. Moderation, suspension and removal

Zerkuri may investigate reports, restrict visibility, remove listings, limit functionality or suspend accounts where there is a reasonable basis to believe that platform rules or applicable law have been violated, or where action is necessary to protect users, the marketplace or payment systems.

Where applicable, Zerkuri may provide information about a moderation decision and available review or appeal options, subject to legal, security and abuse-prevention requirements.

11. Refunds and consumer rights

Refund rights depend on the circumstances of the transaction, applicable law, the seller's legal status and the nature of the digital content. Nothing in these Terms excludes or limits a mandatory consumer right that cannot lawfully be waived.

Digital content supplied immediately after purchase may be subject to specific rules concerning the right of withdrawal. Where required, Zerkuri will seek the buyer's express consent to begin supply and acknowledgement of the consequences for the withdrawal right before immediate digital delivery.

If digital content is defective, inaccessible or does not conform to the contract, the buyer may have statutory remedies in addition to any Zerkuri refund process.

12. Availability and changes to Zerkuri

Zerkuri may add, modify, suspend or discontinue features where reasonably necessary for development, security, legal compliance, maintenance or marketplace operation. Zerkuri does not guarantee that every feature will be available continuously or without interruption.

13. Responsibility and liability

Sellers remain responsible for the digital products they list and the rights they claim to have in those products. Users remain responsible for their own use of downloaded files and for checking whether a product is suitable for their intended software, machine, workflow or purpose.

Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory rights available under applicable law.

14. Closing an account

Users may stop using Zerkuri and may request account closure, subject to retention of information that Zerkuri is legally required or legitimately entitled to retain, including records relating to transactions, fraud prevention, disputes, taxation or legal claims.

Outstanding payment, refund, dispute or compliance matters may need to be resolved before certain account data or seller functionality can be fully closed.

15. Governing law and mandatory rights

These Terms are intended to be governed by the laws applicable to the Zerkuri operator in Hungary, without depriving consumers of mandatory protections that apply to them under the law that cannot validly be excluded by contract.

16. Changes to these Terms

Zerkuri may update these Terms when the marketplace, fees, legal requirements or platform features change. The current version will be published in the Legal Center, and material changes will be communicated where required.
